1. Introduction

Welcome to BinaryCodz Holiday Rental Marketplace (the "Platform"), operated by BinaryCodz ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including our native iOS and Android apps, web dashboard, and related services (collectively, the "Services").

By registering an account, browsing listings, making a booking, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

The Platform connects guests seeking accommodations with hosts offering properties, such as homestays and vacation rentals. We provide the technology to facilitate these connections but are not a party to any rental agreements between guests and hosts.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent that you have the legal capacity to enter into these Terms. We reserve the right to refuse access to anyone for any reason.

3. User Accounts and Onboarding

To access certain features, you must create an account by providing accurate information, such as your email or logging in via Facebook. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You agree to notify us immediately of any unauthorized use. We are not liable for losses due to unauthorized access.

4. Guest Responsibilities

As a guest, you may browse listings, search properties, chat with hosts, book accommodations, make payments, and leave reviews. You agree to:

• Provide accurate booking information and respect host property rules.
• Pay for bookings in full and on time via the provided payment methods.
• Not engage in fraudulent activity or misuse the Platform.
• Communicate respectfully in in-app chats.

Bookings are subject to host availability and approval. Cancellation policies are set by hosts and displayed in listings.

5. Host Responsibilities

As a host, you may create a profile, list properties, manage bookings, communicate with guests, and access analytics. You agree to:

• Provide accurate property details, including photos, descriptions, pricing, and terms & conditions.
• Maintain properties in a safe, clean condition compliant with local laws.
• Respond to guest inquiries promptly and honor confirmed bookings.
• Pay applicable commissions and fees to us.

You represent that you have the legal right to list and rent your property. We may review and approve listings at our discretion.

6. Payments and Fees

We facilitate payments between guests and hosts using secure third-party processors. Guests pay hosts directly for bookings; we collect a commission (as displayed on the Platform) from hosts upon successful completion.

• All payments are final unless otherwise specified in the host's cancellation policy.
• We are not responsible for payment disputes; resolution is between guest and host.
• Refunds, if any, are processed at the host's discretion.
• You authorize us to charge your payment method for applicable fees.

We may offer promotions or paid listings, subject to additional terms.

7. Ratings, Reviews, and Content

You may post reviews and ratings, which must be honest, respectful, and based on your experience. We reserve the right to remove inappropriate content.

All user-generated content (e.g., photos, descriptions) is your responsibility. You grant us a non-exclusive license to use it for Platform purposes.

Do not post illegal, defamatory, or infringing material.

8. Notifications and Communications

We may send push, email, or SMS notifications about bookings, updates, or promotions. You can manage preferences in your profile.

By providing your contact information, you consent to these communications.

9. Admin and Platform Management

Admins (us or authorized users) can manage listings, bookings, users, payments, and notifications. We strive for 99.9% uptime but are not liable for downtime.

10. Prohibited Conduct

You agree not to:

• Violate laws or third-party rights.
• Interfere with the Platform (e.g., hacking, spamming).
• Post false information or engage in scams.
• Use the Services for commercial purposes without permission.

We may suspend or terminate accounts for violations.

11. Intellectual Property

The Platform and Services are owned by BinaryCodz. You may not copy, modify, or distribute our content without permission.

Trademarks, logos, and software are protected.

12. Disclaimers and Limitation of Liability

The Services are provided "as is." We disclaim all warranties, express or implied.

We are not liable for interactions between guests and hosts, property conditions, or damages arising from use. Our liability is limited to the fees paid by you in the last 12 months.

You indemnify us against claims from your use of the Services.
